These general terms and conditions of sale define the rights and obligations of SARL "Le Temps des Grenouilles" (hereinafter, the "Company") and the Customer of "Le Temps des Grenouilles" products on the website "www.letempsdesgrenouilles.fr". They apply exclusively between "Le Temps des Grenouilles" , a limited liability company with a capital of €5,000, registered under the unique number 841 441 530 RCS, whose registered office is located at 151-153 Rue Bouthier, 33100 Bordeaux, France, and any individual consumer visiting or making a purchase via the said Website (hereinafter, the "Customer").
On the Site, "Le Temps des Grenouilles" allows the Customer to order rain protection clothing online, according to these general conditions.
Each order placed with "Le Temps des Grenouilles" implies the Client's unreserved acceptance of these terms and conditions. These terms and conditions may be modified without prior notice and at any time by " Le Temps des Grenouilles," the applicable terms being those in effect on the date the order is placed by the Client.

Products and compliance
The products for sale are presented on the "Le Temps des Grenouilles" website and accompanied by a description.
The products offered by "Le Temps des Grenouilles" comply with the standards applicable in France.
Elements such as photographs, texts, graphics, as well as all information and characteristics illustrating and/or accompanying the Products are not contractual, which the Customer acknowledges.
For each Product, the Customer has a description containing the essential characteristics of the Product concerned.
Customer Obligations
The Customer declares that he is of legal age (over 18 years old) and has the legal capacity or parental authorization to order a product on the Site.
The Client agrees to provide "Le Temps des Grenouilles" with the true and necessary information for the performance of the service covered by these conditions, as requested online and according to their situation, including their name, surname, address, telephone and valid email.
The Client is responsible for the consequences arising from information transmitted that is false or inaccurate or whose use would be unlawful.
Once the order is placed, " Le Temps des Grenouilles" sends the Customer an email confirming it. This email also provides information on how to ship the product.
The Customer can make changes to their data in the "my account" section.
Price, availability and delivery
The prices shown on the Site are given in euros inclusive of all French taxes (French VAT and any other applicable taxes), excluding shipping costs, contribution to order processing costs and packaging costs.
Shipping costs, contribution to order processing costs and packaging costs will then be specified in the Customer's shopping cart, before final validation of the order.
Products delivered to countries outside the European Union are not subject to VAT.
Prices may be changed, increased, or decreased at any time, particularly due to sales or promotional periods.
The cost of telecommunications transmissions incurred by the conclusion and/or execution of this agreement shall be borne by the Client.
In case of dispute, on a previous order, "Le Temps des Grenouilles" has the right to cancel, or refuse an order.
"Le Temps des Grenouilles" can fulfill any order within the limits of available stock.
If, despite all the efforts of "Le Temps des Grenouilles" to monitor stock quantities available and to regularly update them on the site, one of the products ordered by the Customer is unavailable, "Le Temps des Grenouilles" will send an email to the Customer as soon as possible to inform them of this situation and cannot under any circumstances be held responsible, and will not cause any compensation or damages to the Customer, regarding this unavailability.
In the event of unavailability, " Le Temps des Grenouilles" will offer the customer an equivalent item in terms of price. If none of the products offered to the customer are suitable, the customer may cancel their order.
In the event of permanent unavailability, and if "Le Temps des Grenouilles" could not offer an item of equivalent price to the Customer, their order will be automatically cancelled.
After adding the desired item to their cart and clicking "buy," the customer agrees to ensure their solvency before placing any order. In the event of insolvency, " Le Temps des Grenouilles" reserves the right to cancel or suspend any order or delivery.
"Le Temps des Grenouilles" delivers its products in Metropolitan France.
Delivery is made to the address provided by the customer. Delivery to P.O. boxes or hotels is not possible.
Delivery times are indicated on the website when placing the order.
To ensure that this deadline is met, the customer must provide " Le Temps des Grenouilles" with the exact delivery location information (building number, street number, exact street name, postal code, city, staircase number, access codes, first and last names on the intercom).
Any delay due to an incomplete or inaccurate address provided by the customer, proven by "Le Temps des Grenouilles" , does not in any way make "Le Temps des Grenouilles" responsible for this delay.
In the event of force majeure or an unforeseen event, " Le Temps des Grenouilles" would in no way be responsible for any possible delay.
If the package arrives damaged or with missing products or already opened, " Le Temps des Grenouilles" requests that you notify them, by any means, up to three days after receiving the product.
Shipping costs may be fixed and may be higher or lower than the actual shipping costs. The Company reserves this right in order to limit discrepancies in shipping costs between different orders.
Payment
Payment is secure. " Le Temps des Grenouilles" will never have access to its customers' bank details. Payment can only be made by credit card.
"Le Temps des Grenouilles" may cancel an order at any time when the customer's IP address is located in a country other than the billing country.
"Le Temps des Grenouilles" only accepts international cards, within the framework of cards domiciled outside of France.
The order amount is debited at the time of the order when the customer pays by credit card.
It is understood that "Le Temps des Grenouilles" has the authorization to debit the customer's account as soon as the customer has simply provided their bank card, for the amount of their order.
Customs duties
For orders outside of France, customs duties may apply and will be the responsibility of the customer when the package arrives at its destination.
"Le Temps des Grenouilles" is not obligated to inform the customer of any applicable customs duties. Therefore, it strongly recommends that the customer inquire beforehand with the relevant authorities.
Product Returns and Right of Withdrawal
In order to exercise their right of withdrawal, the customer has 14 days from the date of receipt of the product to withdraw.
While respecting this right of withdrawal, the customer can request a return or exchange of one of their products during these 14 days.
Returns or exchanges can be requested by email or via "my account" on the website https://www.letempsdesgrenouilles.fr leading to the approval or rejection of "The Time of the Frogs"
An email explaining the process will then be sent to the customer if the return or exchange of the order is accepted.
Returns must be made within one week in the original packaging and the product must be new, unwashed, unworn, accompanied by a copy or the original invoice, to the following address:

The customer is responsible for the risks associated with returning their package. It is recommended to take out additional insurance or send the package via Colissimo with signature upon delivery.
Proof of return may be requested from the customer at any time.
Return shipping costs are the responsibility of the customer. The customer is free to choose the return method, but we strongly recommend Colissimo with signature confirmation. Despite this advice, if the package is not received, "Le Temps des Grenouilles" will not be able to refund the cost of the unreceived package, nor will it reimburse the return shipping costs.
Special case: If an error (order error: wrong item sent or defective item) originates from " Le Temps des Grenouilles", the Company may cover the return shipping costs. To do so, you will be asked to email a scanned copy of the invoice to be reimbursed for these return shipping costs.
If after one week (after sending the return authorization email), "Le Temps des Grenouilles" has not received the return, the return is cancelled.
The product will be refunded within 15 days of "Le Temps des Grenouilles" receiving the item. This refund does not include return shipping costs and will be issued to the card used for the original payment.
For a size change, the item must be returned, refunded, and the customer will need to place a new order for the new size.
If the customer has not complied with these conditions, in particular those relating to exchange or return, "Le Temps des Grenouilles" will not refund the product in question.
Gift vouchers
"Le Temps des Grenouilles" offers GIFT CARDS (gift vouchers) valid for one year from the date of purchase and for a single order. Customers can purchase them on the website using a credit card.
If the order amount is less than the GIFT CARD amount, the difference will not be refunded.
The customer will be responsible for the shipping costs.
Newsletters
Anyone registered on the Site can subscribe to or unsubscribe from the "Le Temps des Grenouilles" newsletters. They can unsubscribe by sending an email to contact@letempsdesgrenouilles.fr
Retention of title
Until final and full payment of the order, "Le Temps des Grenouilles" remains the owner of the Le Temps des Grenouilles products.
Guarantees and liability
"Le Temps des Grenouilles" will not be responsible for any damage, intrusions, viruses, related to the internet network, or for any event considered "force majeure".
Intellectual Property
No part of the site and in particular what it contains: photos of models, graphics, videos, images, Journal articles, description, product names, site name, may be reproduced, downloaded, or modified.
No part of the site or website may be copied, sold, reproduced or exploited for commercial purposes without having obtained express written permission from the company "Le Temps des Grenouilles".
In general, all copyrights, trademarks and other distinctive signs as well as property or intellectual property rights appearing on the Site, must remain the full and complete property of " Le Temps des Grenouilles " or its partners/suppliers.
The Client may not, under any circumstances, use the brand name, designs, logo, or any other graphic element appearing on the website and the products or derivative products, nor may they register any trademark that infringes upon the rights holder, except with contractual authorization. They must respect intellectual property rights.
Protection of personal data
"Le Temps des Grenouilles" undertakes to use the confidential information of Clients only in the context of the operation of its Site.
The customer acknowledges that the personal data previously collected by the site will be subject to computer processing for the proper execution of the order.
Technical service providers or partners of "Le Temps des Grenouilles" may therefore have access to this data.
Customer contact details will be used in accordance with the preferences expressed during registration.
The Customer may refuse the possible transfer of their personal data to a third party, which may lead to the cancellation of the order as it becomes impossible to process it.
Furthermore, " Le Temps des Grenouilles" may use techniques to acquire non-personal information relating to internet users in order to improve the functioning of the site (e.g. the number of visitors per page)
In accordance with the French Data Protection Act of 6 January 1978, as amended by the Act of 6 August 2004, the Customer has the right to access and rectify personal data concerning them held in the files of "Le Temps des Grenouilles" . This computer processing was declared to the National Commission for Information Technology and Freedoms (CNIL), which issued receipt no. 1421436 on March 30, 2010.
Force majeure
In the event of force majeure preventing the performance of these Terms and Conditions, " Le Temps des Grenouilles" shall inform the Client within fifteen (15) days of the occurrence of such event, by email or registered letter with acknowledgment of receipt. Specifically, the following shall be considered force majeure or fortuitous events, in addition to those usually recognized by French courts: total or partial strikes, lockouts, riots, boycotts or other industrial actions or commercial disputes, civil unrest, insurrection, war, severe weather, epidemics, blockages of transportation or supply routes for any reason whatsoever, earthquakes, fires, storms, floods, water damage, governmental or legal restrictions, legal or regulatory changes to marketing methods, computer failures, telecommunications outages, including wired or wireless telecommunications networks, and any other event beyond the control of the parties preventing the normal performance of the contractual relationship. All obligations of the parties are suspended for the entire duration of the force majeure event, without compensation. If the force majeure event continues for more than three (3) months, the contract in question may be terminated automatically without compensation for either party.
In the event of a force majeure event, the party concerned must inform the other party within fifteen (15) days of the occurrence of this event, by registered letter with acknowledgment of receipt.
Specifically, force majeure or fortuitous events are defined as those typically recognized by French courts and tribunals. All obligations of the parties will be suspended for the entire duration of the force majeure event, without compensation.
If the force majeure event continues for more than three (3) months, the contract in question may be terminated automatically without compensation for either party.
Newspaper
" Le Temps des Grenouilles " publishes a blog on its website, at https://letempsdesgrenouilles.fr/blogs/le-blog where customers will be able to post comments on articles published by " Le Temps des Grenouilles ".
"Le Temps des Grenouilles " reserves the right to remove any content, including content that may violate the law, public morals, or any defamatory content.
Users can notify "Le Temps des Grenouilles" of illegal or offensive content by sending an email to contact@letempsdesgrenouilles.fr
General provisions
If any provision of these terms and conditions is declared invalid or unenforceable by a court of competent jurisdiction, it shall be deemed unwritten and shall not invalidate the remaining provisions.
These general terms and conditions may be modified at any time and without notice by " Le Temps des Grenouilles", the applicable terms being those in force on the date of the order by the Customer.

These terms and conditions are governed by French law, both substantively and procedurally. Amicable settlement will be preferred for resolving any dispute.
