These general terms and conditions of sale aim to define the rights and obligations of SARL Le Temps des Grenouilles (hereinafter, the “Company”) and the Customer of “Le Temps des Grenouilles” products on the website “www.letempsdesgrenouilles.fr”. They apply exclusively between Le Temps des Grenouilles, a limited liability company with a capital of €5,000, registered under the unique number 841 441 530 RCS, with its registered office located at 219 Rue Saint Martin 75003 Paris, France, and any individual consumer visiting or making a purchase via the said Website (hereinafter “the Customer”).

On the Website, Le Temps des Grenouilles allows the Customer to order rain protection clothing online, according to these general terms and conditions.
Each order placed with Le Temps des Grenouilles results in the Customer’s unconditional acceptance of these terms and conditions. These general terms and conditions may be modified without notice at any time by the Company, Le Temps des Grenouilles, the applicable conditions being those in effect on the date of the Customer’s order.
These general terms and conditions of sale are permanently accessible at the following address:

Products and compliance
The Products for sale are presented on the Le Temps des Grenouilles website and accompanied by a description.
The Products offered by Le Temps des Grenouilles comply with the applicable standards in France.
Elements such as photographs, texts, graphics, and all information and characteristics illustrating and/or accompanying the Products are not contractual, which the Customer acknowledges.
The Customer has, for each Product, a description containing the essential characteristics of the Product concerned.

Customer obligations
The Customer declares that they are of legal age (over 18 years old) and have legal capacity or hold parental authorization allowing them to order a product on the Website.

The Customer undertakes to provide Le Temps des Grenouilles with true and necessary information to perform the service covered by these terms as requested online and according to their situation, including their first name, last name, address, telephone number, and valid email.
The Customer is responsible for the consequences of false or inaccurate information provided or of information whose use would be illegal.

Once the order is placed, Le Temps des Grenouilles sends the Customer an email confirming it. It provides information on the shipment of the product.

The Customer can make changes to their data in the “my account” section.

Price, availability, and delivery
Prices shown on the Website are given in euros including all French taxes (French VAT and other applicable taxes), excluding shipping costs, order processing fees, and packaging costs.
Shipping costs, order processing fees, and packaging costs will be specified in the Customer’s cart before final confirmation of the order.
Products shipped to countries outside the European Union are not subject to VAT.
Prices may be modified, increased, or decreased at any time, notably due to sales periods or promotions.
The cost of telecommunications incurred by the conclusion and/or execution of these terms remains the responsibility of the Customer.

In case of dispute regarding a previous order, Le Temps des Grenouilles has the right to cancel or refuse an order.

Le Temps des Grenouilles may fulfill any order subject to available stock.
If despite Le Temps des Grenouilles’ efforts to monitor available stock quantities and update them regularly on the website, one of the Products ordered by the Customer is unavailable, Le Temps des Grenouilles will send an email to the Customer as soon as possible to notify them of this situation and cannot be held responsible under any circumstances, nor will it give rise to any compensation or damages to the Customer regarding this unavailability.
In case of unavailability, Le Temps des Grenouilles will propose to the Customer an equivalent product in terms of price. If none of the products offered to the Customer is suitable, the Customer may cancel their order.
In case of permanent unavailability, and if Le Temps des Grenouilles cannot offer an equivalent-priced item to the Customer, their order will be automatically canceled.

The Customer, after adding the item they wish to purchase to their cart and clicking “buy,” undertakes to ensure their solvency before any order. In case of insolvency, Le Temps des Grenouilles may cancel or suspend any order or delivery.

Le Temps des Grenouilles delivers its Products in Metropolitan France.
Delivery is made to the address provided by the Customer. It is not possible to deliver to PO boxes or hotels.

Delivery times are indicated on the website at the time of order.
To ensure that this deadline is met, the Customer must provide accurate delivery information to Le Temps des Grenouilles (building number, street number, exact street name, postal code, city, staircase number, access codes, first and last names on intercom).
Any delay due to incomplete or inaccurate address information provided by the Customer, proven by Le Temps des Grenouilles, shall not in any way make Le Temps des Grenouilles responsible for such delay.
In case of force majeure or an unforeseeable event, Le Temps des Grenouilles shall also not be responsible for any possible delay.

If the parcel arrives damaged or with missing or already opened products, Le Temps des Grenouilles requests to be notified, by any means, within three days of receipt of the product.

Delivery costs may be fixed and may be higher or lower than the actual delivery costs. The Company reserves this right to limit differences in delivery costs between different orders.

Payment
Payment is secure. Le Temps des Grenouilles will never have access to the Customers’ bank details. Payment can only be made by credit card.

Le Temps des Grenouilles may at any time cancel an order when the Customer’s IP address is located in a country different from the billing country.
Le Temps des Grenouilles only accepts international cards issued outside France.
The order amount is debited at the time of order when the Customer pays by credit card.
It is understood that Le Temps des Grenouilles is authorized to debit the Customer’s account once the Customer has provided their credit card for the amount of the order.

Customs duties
For orders outside France, customs duties may apply, and they will be the responsibility of the Customer at the time the parcel arrives at its destination.
Le Temps des Grenouilles is not required to inform the Customer of these applicable customs duties. Therefore, it strongly recommends that the Customer obtain prior information from the competent authorities.

Product returns and withdrawal rights
To exercise their right of withdrawal, the Customer has, from the date of receipt of the product, 14 days to withdraw.
While respecting this right of withdrawal, the Customer may request a return or exchange of one of their products during these 14 days.

These returns or exchanges may be requested by email or via “my account” on the website www.letempsdesgrenouilles.fr, resulting in acceptance or refusal by Le Temps des Grenouilles.
An email explaining the procedure to the Customer will then be sent if the return or exchange of the order is accepted.

Returns must be made within one week in the packaging used for shipment, and the product must be new, unworn, unwashed, accompanied by a copy or original of the invoice, to the following address: Le Temps des Grenouilles, 76 Cours Portal, 33 000 BORDEAUX.

The Customer is responsible for the risks associated with returning their parcel. It is recommended to take additional insurance or send the parcel via Colissimo with signature upon receipt or any other method allowing compensation up to the value of the items in case of loss, theft, or damage.

Proof of return may be requested from the Customer at any time.

Return costs are the responsibility of the Customer. They are free to choose the return method, but Colissimo with signature upon receipt is strongly recommended. Despite this recommendation, if the parcel is not received, Le Temps des Grenouilles cannot refund the missing parcel or the shipping costs for its return.
Special case: if an error (error in the order: wrong item sent or defect of the item) originates from Le Temps des Grenouilles, the Company may cover these return costs. To do so, the invoice (scanned) must be sent by email to be reimbursed for these return costs.

If after one week (after sending the return authorization email), Le Temps des Grenouilles has not received the return, it is canceled.

The product will be refunded within 15 days once Le Temps des Grenouilles has received the item. This refund does not include return costs and will be made to the card used for payment.
For a size change, the item must be returned, refunded, and the Customer must place a new order for the new size.
If the Customer has not complied with these conditions, particularly for exchange or return, Le Temps des Grenouilles will not refund the product in question.

Gift cards
Le Temps des Grenouilles offers GIFT CARDS valid for 1 year from the date of purchase and for a single order. The Customer can acquire them on the website by credit card.
If the order amount is less than the value of the GIFT CARD, the difference will not be refunded.
The Customer must pay shipping costs.

Newsletters
Anyone registered on the Website can subscribe or unsubscribe from Le Temps des Grenouilles newsletters. They can unsubscribe by sending an email to contact@letempsdesgrenouilles.fr

Retention of title
Until full and final payment of the order, Le Temps des Grenouilles remains the owner of the Le Temps des Grenouilles products.

Warranties and liability
Le Temps des Grenouilles shall not be liable under any circumstances for damages, intrusions, viruses related to the Internet, or any so-called “force majeure” events.

Intellectual property
No part of the website, in particular its content: photos of models, graphics, videos, images, Journal articles, descriptions, product names, site name, may be reproduced, downloaded, or modified.
No part of the website may be copied, sold, reproduced, or exploited commercially without the express written authorization of Le Temps des Grenouilles.
In general, all copyrights, trademarks, and other distinctive signs, as well as property or intellectual property rights appearing on the Website, shall remain the full and entire property of Le Temps des Grenouilles or its partners/suppliers.
The Customer may under no circumstances use the brand name, models, logo, or any other graphic element on the website and products or derivative products, or register a trademark that would infringe the rights holder, except with contractual authorization. They must respect intellectual property rights.

Personal data protection
Le Temps des Grenouilles undertakes to use Customers’ confidential information only for the operation of its Website.
The Customer acknowledges that the personal data collected by the site will be subject to computer processing for the proper execution of the order.
Technical service providers or partners of Le Temps des Grenouilles may have access to this data.
Use of Customers’ contact information will be in accordance with the expressed preferences during registration.
The Customer may refuse any transfer to a third party of their personal data, which may result in the cancellation of the order as it cannot be processed.

Furthermore, Le Temps des Grenouilles may use techniques to acquire non-personal information about internet users to improve the functioning of the site (e.g., number of visitors per page).
In accordance with the law of January 6, 1978, amended by the law of August 6, 2004, the Customer has a right of access and correction of personal data concerning them in Le Temps des Grenouilles’ files. Any request must be sent by email to: contact@letempsdesgrenouilles.fr

This computer processing has been declared to the National Commission for Computing and Freedoms (CNIL), which issued receipt no. 1421436 on March 30, 2010.

Force majeure
In the event of a force majeure event preventing the execution of these GTC, Le Temps des Grenouilles will inform the Customer within fifteen (15) days of the occurrence of such event, by email or registered letter with acknowledgment of receipt.
Expressly, force majeure or fortuitous events include, in addition to those usually recognized by the jurisprudence of French courts, total or partial strikes, lockouts, riots, boycotts or other industrial actions or commercial disputes, civil unrest, insurrection, war, bad weather, epidemics, blockage of transport or supply for any reason, earthquakes, fire, storms, flooding, water damage, governmental or legal restrictions, legal or regulatory changes in marketing forms, computer breakdowns, telecommunications blockages including wired or wireless networks, and any other case beyond the parties’ control preventing normal contractual execution.
All obligations of the parties are suspended during the entire duration of the force majeure event without compensation. If the force majeure event lasts more than three (3) months, the concerned contract may be terminated automatically without compensation for either party.
In the event of a force majeure event, the affected party must inform the other within fifteen (15) days of its occurrence by registered letter with acknowledgment of receipt.

General provisions
If any provision of these terms is declared null or unenforceable by a competent jurisdiction, it shall be considered unwritten and shall not affect the validity of the remaining provisions.

These general terms may be modified at any time and without notice by Le Temps des Grenouilles, the applicable terms being those in effect on the date of the Customer’s order.

These general terms are governed by French law regarding both substantive and procedural rules. Amicable settlement will be prioritized to resolve any dispute.
